Membership:  The Board of Adjustment consists of six members and two alternates who are appointed by the City Commission to serve staggered three-year terms.  Board members must be residents of the City and shall not serve at the same time on any other City board. 

General Functions:  The Board of Adjustment has three general functions, which are listed below.  The procedure for granting a Special Use Permit is found in Article 7, Section 7.09.00, "Procedure for Granting a Special Use Permit".  The criteria for granting variances is found in Article 7, Section 7.11.01, "Criteria for Granting a Variance."

Special Exception Use Permits - The Board shall have the power to hear and decide on applications for special exception use permits in conformance with this ordinance in order to allow the property integration into the community of uses that are specifically designated in this ordinance but which may be suitable only in specific locations within the zoning district and then only if certain conditions are met.

Variances - The Board conducts public hearings and decides on appeals for dimensional variances where, by reason of the exception narrowness, shallowness or unusual shape of a site or by reason of exceptional topographic conditions, or some other extraordinary situation or condition of that site, the literal enforcement of the dimensional requirements (height or width of building or size of yards, but not dwelling unit or population density) of this ordinance would deprive the applicant of reasonable capacity to make use of the land in a manner equivalent to the use permitted other landowners in the same zoning district.

Appeal of Administrative Officer’s Decision - The Board also has the power to hear and decide on appeals where it is alleged there is error in any order, requirement, decision or determination made by the administrative official in the enforcement of the Unified Land Development Code.

Meeting Schedules: The Board of Adjustments meets on the fourth Thursday of any given month provided there are items that need reviewed.  The meeting begins at 5:30 p.m. (EST) and is held in the City Commission Chambers, City Hall, 450 North Wilson Avenue.  Meeting dates are subject to change and additional meetings may be added if necessary.
